SIA “Berg Research” PERSONAL DATA PROCESSING POLICY

  1. This Personal Data Processing Policy has been prepared to set forth the principles regarding processing your personal data which you have shared with SIA “Berg Research”. Registration nr.: 40103672498, legal address: Viskalnu iela 15, Tīraine, Mārupes novads, Latvija (hereinafter – Berg Research).

3. Personal data processing policy applies to:

3.1. The policy governs the processing of personal data, which applies to all Berg Research:

3.1.1. Existing clients who are natural persons and who use Berg Research Services;

3.1.2. Potential clients who are natural persons who do not have an established relationship with Berg Research and who are interested in Berg Research Services;

3.1.3. Former clients, including those whose contractual obligations have not been fulfilled or who have agreed to receive commercial communications upon the termination of the contract;

3.1.4. Client representatives, including contact persons and legal representatives;

3.1.5. Information system, website users;

3.1.6. Lottery participants;

3.1.7. Natural persons engaged in marketing activities.

3.2. The Policy provides information on how Berg Research handles personal data using its internal resources, including information systems and website www.bergresearch.lv, in connection with the Services offered by Berg Research.

3.3. To inform you about the processing of personal data, Berg Research provides you with the following information by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons regarding the processing of personal data (hereinafter – the Regulation)

4. Personal data and purposes of personal data processing

4.1. Personal data is any kind of information relating to an identified or identifiable natural person (data subject).

4.2. Berg Research processes personal data for the provision of its services:

4.2.1. Ensuring and improving the operation of the website bergresearch.lv;

Berg Research processes your data to improve its website and make it more convenient for its users. Also, for security reasons, Berg Research records the IP address to investigate possible incidents and protect the web page.

– Personal data to be processed

actions performed on the website – IP address, device, browser, OS, names of the activity performed, a section of the website, date and time, cookies;

– Legal basis for the processing of personal data

Legitimate interests of the controller (Article 6, paragraph one, point (f) of the General Data Protection Regulation).

– Duration of data storage

Berg Research will store the data of the activities carried out on the website for a maximum of 2 (two) years unless the record contains the information necessary to achieve a specific purpose. In this case, the record is retained until the established issue is clarified or the relevant investigation is completed.

4.2.2. Membership of the Berg Research interest group;

Berg Research offers its respondents to become members of the interest group and maintains a database of respondents, the purpose of which is to offer group members the opportunity to participate in various social and marketing research, as well as in research and tests of interest groups using the following communication channels: Internet, e-mail, telephone.

Personal identification data – name, gender, year of birth, nationality, level of education, contact information – email address, phone number.

Consent (Article 6, Paragraph one, Clause a of the General Data Protection Regulation);

– Duration of data storage

Until you withdraw your consent to participate in an interest group or delete your user profile on www.bergresearch.lv website or if you have not participated in any studies within 24 months.

4.2.3. Berg Research offers respondents to participate in social and marketing research created by Berg Research, studies and tests of interest groups using the following communication channels: Internet, e-mail, telephone, and face-to-face interviews.

– Personal data to be processed

Personal data – name, gender, year of birth, nationality, level of education, activities carried out on the website using online survey platforms – IP address (additional information on data processing is available on the website of the survey service provider);

In certain cases:

Contact information – e-mail address, phone number (If you agree to participate in the Berg Research Interest Group or to participate in the lottery of a particular survey);

Video recording – your image and recordings, as well as all your other personal data and activities that are recorded during the video recording;

Audio recording – your voice recording, as well as all your other personal data that you provide during the study – according to the purpose of data processing;

Photo – the image of you.

Consent (Article 6, Paragraph one, Clause a of the General Data Protection Regulation);

– Duration of data storage

Until you withdraw your consent to data processing. Until the analysis of the data of a particular study is completed and anonymized, but not longer than 2 (two) years.

4.2.4. Lotteries and offer promotion

Berg Research processes your data to administer lotteries if you have expressed a wish to participate in them. Berg Research also processes your data to determine and notify the winner, also to identify you when issuing lottery prizes, as well as to include your name and surname in the lottery protocol by a legal obligation.

Personal identification data – name, contact information – e-mail address, phone number;

Data on participation in lotteries, games, promotions, or campaigns – points won, prizes won in games, lotteries, or promotions;

– Legal basis for the processing of personal data

Fulfillment of legal obligations (General Data Protection Regulation, Article 6, Paragraph one, Point (c));

Legitimate interests of the controller (Article 6, paragraph one, point (f) of the General Data Protection Regulation), identification of the contact person, and provision of communication.

– Duration of data storage

Personal data necessary to achieve the purpose will be stored until the end of the lottery, and promotions. Personal data that must be stored to comply with the requirements of legal acts will be stored for the periods specified in the relevant regulatory enactments.

8. Legal bases for the processing of personal data

8.1. Berg Research processes Personal Data in the following cases:

8.1.1. A contract has been or will be concluded between you and Berg Research. In this case, Berg Research processes Personal Data for the performance of a contract or for taking measures upon request before entering a contract;

8.1.2. The processing of personal data is necessary to fulfill the legal obligations specified in regulatory enactments applicable to Berg Research. Berg Research is obliged to ensure the provision of information to public authorities, comply with accounting document management obligations, as well as to archive documents;

8.1.3. The processing of personal data is necessary for compliance with the legitimate interests of Berg Research or a third party.

8.1.3.1. Legitimate interests are rights, that are permissible by regulatory enactments, including in connection with the contract concluded between Berg Research.

Berg Research has the following legitimate interests:

8.1.3.1.1. To ensure the development of Berg Research commercial activities;

8.1.3.1.2. To design and develop its Services and ensure their improvement;

8.1.3.1.3. To ensure the maintenance of positive relations with Clients;

8.1.3.1.4. To prevent potential financial and organizational risks;

8.1.3.1.5. To prevent legal risks (for example, to store Personal Data for a certain period in the event of a potential dispute for the resolution of the dispute);

8.1.3.1.6. To prevent security risks;

8.1.3.1.7. To ensure the fulfillment of contractual obligations and to ensure the proper performance of contracts;

8.1.3.1.8. To protect Berg Research financial interests;

8.1.3.1.9. To sustain and attract Clients;

8.1.3.1.10. To maintain the operation of the website, develop and implement its improvements, as well as ensure its use for Clients;

8.1.3.1.11. To carry out marketing activities, including promotion of advertising and distribution of the Services;

8.1.3.1.12. To protect their rights by using the services of authorized and competent authorities.

8.1.4. Berg Research receives the data subject’s consent to the processing of Personal Data (including in writing, electronically on the website, by making a digital audio/video recording, as well as by telephone).

9.1. Berg Research may transfer Personal Data to the following recipients:

9.1.1. Berg Research employees and authorized persons who process the Personal Data specified in this Policy on behalf of Berg Research within the scope of their competence and terms of reference;

9.1.4. Law enforcement agencies, other state institutions and public persons and similar persons, if deemed necessary or obliged in accordance with the applicable laws and regulations (e.g., courts, police, prosecutor’s office, State Revenue Service, notaries);

10. Term of personal data processing

10.1. Personal data are processed to the extent that is reasonably necessary depending on the specific purpose of data processing, in compliance with the provisions of the applicable laws and regulations.

10.2. Berg Research stores Personal Data:

10.2.1. For as long as required or permitted by law;

10.2.2. If the contract is in force (if this Personal Data is related only to this specific contract);

10.2.3. If it is necessary to achieve the purposes of personal data processing specified in Paragraph 4 and sub-paragraphs thereof of the Policy and its terms.

 

11. Transfer of personal data outside the European Union

11.1. Berg Research does not transfer Personal Data outside the European Union.

 

12. Rights of the data subject (you) within the framework of personal data processing

12.1.Rights of the Data Subject in relation to the Personal Data referred to in this Policy:

12.1.1. Right of access:

12.1.1.1. Obtain confirmation from Berg Research as to whether Personal Data is processed in relation to the data subject.

12.1.1.2. If Berg Research processes your Personal Data, then you have the right to access the relevant Personal Data and receive information about the purposes of processing, categories of Personal Data, categories of recipients of Personal Data, the period of storage of Personal Data, your data protection rights, the source of receipt of Personal Data and automated decision-making (if any). The above information can be found in this Policy.

12.1.1.3. Additional information about your Personal Data can be obtained using the contact information of Berg Research specified in paragraph 3 and sub-paragraphs of the Policy.

12.1.1.4. In the case of requests submitted in electronic form, Berg Research shall provide the information in electronic format.

12.1.2. Right to edit data

12.1.2.1. You have the right to request that Berg Research correct inaccurate Personal Data.

12.1.3. Right to delete data.

12.1.3.1. You have the right to request that Berg Research delete your Personal Data if:

12.1.3.2. You have withdrawn your consent to the processing of Personal Data, considering that the withdrawal of consent does not affect the processing of data that was carried out during the period of validity of the given consent;

12.1.3.3. Personal data are no longer necessary in relation to the purposes specified in paragraph 4 and sub-paragraphs of the Policy for which they were processed;

12.1.3.4. Personal data are processed unlawfully;

12.1.3.5. Personal data must be deleted in accordance with the requirements of regulatory enactments;

12.1.3.6. The right to erasure does not apply to cases where, in accordance with the law, Berg Research is obliged to process Personal Data or data processing is necessary for archiving, public interest or statistical purposes, as well as in connection with the establishment, exercise or defense of a legal claim.

12.1.4. The right to limit the processing of Personal Data.

12.1.4.1. You have the right to limit the amount of your Personal Data to be processed by Berg Research if:

12.1.4.1.1. You contest the accuracy of personal data or the lawfulness of your Personal Data processing (the limitation will work while the contested process is ongoing);

12.1.4.1.2. The processing of personal data is illegal, but you object to the erasure of personal data;

12.1.4.1.3. Berg Research Personal Data is no longer needed, but you need it to establish, exercise or defend legal claims.

12.1.5. Right to object to data processing.

12.1.5.1. You have the right to object at any time to the processing of your Personal Data based on the legitimate interests and consent specified in Paragraph 5 and Sub-paragraphs, as well as profiling or automated decision-making described in Paragraph 10 and Sub-paragraphs. Berg Research has the right to continue processing your Personal Data despite the objections received, if Berg Research indicates compelling legitimate reasons for the processing that override your interests, rights, and freedoms, or in order to establish, exercise or defend legal claims.

12.1.5.2. In cases where Berg Research uses your Personal Data for direct marketing purposes, you have the right to object at any time to the processing of your Personal Data for such purposes, when this includes profiling.

12.1.6. The right to withdraw consent.

12.1.6.1. You have the right to withdraw your consent to the processing of Personal Data in cases where consent is the basis for the processing of Personal Data.

12.1.6.2. To withdraw your consent, you can use the contact information of Berg Research specified in paragraph 3 and sub-clauses of the Policy.

12.1.6.3. If you withdraw your consent, Berg Research has the right to restrict the provision of services, if it depends on the existence of the relevant Personal Data.

12.1.6.4. The withdrawal of consent shall not affect the processing of data carried out during the period of validity of the consent given.

12.1.7. Right to portability.

12.1.7.1. You have the right to receive your Personal Data, which you provided to Berg Research, in a structured, commonly used, and machine-readable format and have the right to request the transfer of that data to another controller (service provider) if this Personal Data is processed based on a contract or consent.

12.1.8. Right to lodge a complaint.

12.1.8.1. You have the right to lodge a complaint with Berg Research, as well as with the Latvian supervisory authority, the Data State Inspectorate, if you believe that your personal data protection rights have been violated. If you wish to submit a complaint to the Data State Inspectorate, please contact Berg Research before contacting the Inspectorate. Berg Research takes care of the protection of your Personal Data and will provide you with the necessary support.

12.1.8.2. You may use the contact details of Berg Research specified in paragraph 3 and sub-clauses of the Policy to exercise these rights, unless otherwise specified in this section.
